Terms of Service

Last updated September 11, 2026

These are the terms for using the Vizualize app and the vizualize.app website. They are written to be read, not skimmed past. The short version: the app is yours to use, your work is yours, Premium is a subscription you can cancel any time, and an AI tutor can be wrong — check what matters.

1. Who we are

Vizualize ("Vizualize", "we", "us") is operated by Ethan Whitaker, based in Kentucky, United States. By installing the app, creating an account, or using the website, you ("you") agree to these terms. If you do not agree, do not use Vizualize.

2. Using the app

We give you a personal, non-exclusive, non-transferable licence to install and use the Vizualize desktop app on computers you own or control, for your own learning. The free tier is free for as long as you like, with no account required.

You may not sell, rent, sublicense, or redistribute the app; reverse-engineer it except where the law expressly allows; remove its notices; or use it to build a competing product. The app's own code is copyrighted and is not open source. It is built on open-source software from other authors, whose licences and credits are listed in Settings → Data & Privacy → Open-source licences.

3. Accounts

An account is optional and exists so Premium can be attached to you. You must be at least 13 years old (16 in the European Economic Area) to create one, and you must give a real email address you control. Keep your password private; what happens under your account is your responsibility. Tell us if you think someone else has access to it.

4. Premium

What it is. Premium is a paid subscription that adds features on top of the free tier: cloud AI with nothing to set up, the Workshop, document exports, and advanced Study tools. The current list and price are on the pricing page. Everything you need in order to learn stays on the free tier; Premium does not gate lessons, checkpoints, visuals, or Study Cards.

Billing. Premium is billed in advance, monthly or yearly, and renews automatically at the end of each period until you cancel. Prices are in US dollars. Sales tax or VAT may be added depending on where you are. Payments are processed by our payment provider, which acts as the merchant of record for your purchase and whose terms of sale also apply to the transaction; we never see or store your card number.

Cancelling. Cancel any time from Settings → Account → Manage subscription. Cancelling stops future charges; Premium stays on until the end of the period you have already paid for, then your account returns to the free tier. Nothing you made is deleted.

Price changes. If we change the price of Premium, we will tell you by email at least 30 days before it applies to your next renewal, and you can cancel before then.

Refunds. See the Refund Policy, which is part of these terms.

5. Cloud AI and fair use

Premium includes a monthly allowance of cloud AI (described on the pricing page as "up to ~500 lessons a month"). The allowance is measured in the amount of text sent to and received from the AI models, resets on the first of each calendar month, and does not carry over. It is generous for a person learning; it is not unlimited. We may adjust the allowance and will show the current figure in the app.

The allowance is for your own learning inside Vizualize. Using it through automation or scripts, sharing an account so several people draw on one allowance, or reselling or extracting the AI output as a service, is not allowed and may result in the allowance being suspended.

When the allowance is used up, the app says so, and every feature keeps working with an AI model on your own computer or your own API key.

6. Your content

The courses you generate, the documents you write in the Study, your decks, notes, and highlights are yours. We claim no ownership of them. Almost all of it is stored only on your computer. Where you use Premium's cloud AI, the text you send is processed to produce the answer and is not kept by us afterwards; see the Privacy Policy for exactly what is stored and for how long.

You are responsible for what you put into the app, including having the right to use any documents or images you attach.

7. About AI answers

Vizualize teaches with AI models. They are useful and they are fallible: they can state things confidently that are wrong, out of date, or invented, including citations. The app marks AI-generated text and shows where a fact came from wherever it can, but it cannot guarantee accuracy. Vizualize is a study aid, not a substitute for a textbook, a teacher, or a professional. Do not rely on it for medical, legal, financial, safety-critical, or exam-graded decisions without checking against an authoritative source.

8. Acceptable use

Do not use Vizualize to break the law, to harm others, to generate material that is illegal where you are, to attack or overload our services, or to try to get around the allowance, the Premium checks, or the security of other people's accounts. Do not use the Workshop's tools to attack systems you do not own or have permission to test.

9. Third-party material

Lesson pictures, citations, and reading material can come from public collections and libraries, and are shown with a credit line. Their copyright and licence terms belong to their owners and are shown alongside them; reuse them accordingly. The app also lets you attach your own AI provider account; your use of that provider is governed by their terms, not ours.

10. Warranties and liability

Vizualize is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and accuracy of AI output. We do not promise the app or the service will be uninterrupted or error-free.

To the fullest extent the law allows, our total liability to you for any claim arising from Vizualize is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect, incidental, or consequential losses, including lost data or lost marks. Some places do not allow these limits; where that is the case, they apply only as far as the law permits, and nothing here limits rights you have as a consumer that cannot be waived.

Back up what matters to you. The app stores your work on your own computer, and you can export it at any time.

11. Ending the agreement

You can stop using the app at any time, and you can ask us to delete your account by emailing support@vizualize.app. We may suspend or close an account that breaks these terms; if we close a paid account for a reason other than a breach, we will refund the unused part of the current period.

12. Changes to these terms

We may update these terms as the product changes. For material changes we will tell you by email (if you have an account) or in the app at least 14 days before they take effect. Continuing to use Vizualize after that date means you accept the new terms.

13. Law and disputes

These terms are governed by the laws of the State of Kentucky, United States, without regard to its conflict-of-law rules. If something goes wrong, email us first — most problems are fixed in a reply. Any dispute that cannot be resolved that way will be brought in the state or federal courts located in Kentucky, and you and we agree to their jurisdiction, except that you may bring a claim in small-claims court where you live, and consumers in the EU or UK keep the protections of their local law.
